Exploring SLAPPs at the Congress of the German Republican Lawyers’ Association

PATFox Germany coordinator Philipp Wissing (Blueprint for Free Speech) attended the congress of the German Republican Lawyers Association (RAV), presenting a workshop on "Strategic Lawsuit(s) Against Public Participation - Opportunities and Challenges in Defending Against Legal Abuse at the Expense of the Critical Public." The workshop shed light on the concerning phenomenon of Strategic Lawsuits Against Public Participation (SLAPPs) and explored strategies to combat this form of legal abuse. 

One key element in the fight against SLAPPs is to raise awareness among the legal profession. Many lawyers are unfamiliar with SLAPPs as a pervasive problem and lack the knowledge and expertise to effectively represent journalists and activists facing baseless accusations. The workshop emphasized the need for specialized training to equip legal professionals with a deep understanding of the SLAPP phenomenon and to develop appropriate defense strategies.

During the workshop, Philipp Wissing, the coordinator of the German branch of the PATFox project, shared insights and experiences gained from training practices. His presentation shed light on the importance of collective efforts and proactive defense strategies in countering SLAPPs. One of the central themes that emerged during the discussion was the inherent complexity in distinguishing between abusive and non-abusive legal actions. Participants engaged in intensive and, at times, controversial debates as they grappled with the challenge of defining the threshold beyond which legal means transition from legitimate defense to oppressive tactics. Striking the right balance is crucial to ensure that individuals and organizations can exercise their freedom of speech without fear of retribution, while still safeguarding the right to access the law.

A key aspect highlighted during the workshop was the significance of public relations work in SLAPP cases. Lawyers play a crucial role in not only providing legal representation but also shaping public perceptions and mobilizing support for their clients. Crafting compelling narratives and engaging with the media can help counter the chilling effect of SLAPPs by bringing attention to the broader implications of such lawsuits on society's right to engage in critical discourse. By strategically utilizing public relations strategies, German lawyers can amplify their clients' voices and rally public support against the abuse of legal means.

The workshop emphasized the importance of forming alliances with various Anti-SLAPP actors to strengthen the defense against legal abuse. Collaboration with journalists' associations, civil society organizations, and human rights defenders can create a united front in advocating for legislative measures that curb SLAPPs and protect freedom of expression. By fostering these coalitions, German lawyers can tap into collective expertise and resources, ultimately bolstering their ability to defend clients and effectively challenge abusive legal actions.
